Terms of Service

These Terms of Service ("Terms") govern your use of NextIELTS. By creating an account or using the service, you agree to these Terms.

1. The service

NextIELTS provides AI-assisted IELTS exam preparation, including practice drills, mock tests, and AI-generated feedback and band score estimates across reading, listening, writing, and speaking.

AI-generated scores are estimates for practice purposes only. They are produced by automated systems and are not official IELTS scores, are not issued or endorsed by IELTS, the British Council, IDP, or Cambridge Assessment English, and should not be relied on as a guarantee of your actual exam result.

2. Accounts

You must provide accurate information when creating an account and are responsible for maintaining the security of your account credentials and for all activity under your account.

3. Subscriptions and billing

Some features require a paid subscription. Subscription plans, pricing, and included usage limits are described on our pricing page and may change from time to time; we will give notice of material price changes before they take effect on your next billing cycle. Subscriptions are billed and renewed automatically through our payment processor, Stripe, until cancelled.

4. Cancellation

You may cancel your subscription at any time from your billing settings, or by contacting support. Cancelling schedules your subscription to end at the close of your current paid period — you keep full access until then, no future charges are made, and you can resume before that date to keep your subscription active without interruption.

5. Refunds

Subscription payments are non-refundable, including for partial months or unused time in a billing period. Because you can cancel at any time to stop future charges while keeping the access you already paid for, we do not offer prorated or partial refunds. If you believe you were charged in error — for example, a duplicate charge or a billing system malfunction — contact us and we will make it right.

6. Acceptable use

You agree not to:

• Use the service for any unlawful purpose
• Attempt to circumvent usage limits, rate limits, or access controls
• Reverse-engineer, scrape, or resell access to the service
• Submit content that infringes another party's rights or violates applicable law
• Interfere with or disrupt the service's infrastructure

We may suspend or terminate accounts that violate these Terms.

7. Intellectual property

NextIELTS and its content, features, and underlying technology are owned by us or our licensors. You retain ownership of the content you submit (such as essays and recordings); by submitting it, you grant us a license to process it as needed to provide the service, including sending it to our AI and transcription providers as described in our Privacy Policy.

8. Disclaimers

The service is provided "as is." AI-generated feedback may contain errors or inaccuracies. We do not guarantee that use of the service will result in any particular exam outcome.

9. Limitation of liability

To the maximum extent permitted by law, NextIELTS will not be liable for indirect, incidental, or consequential damages arising from your use of the service, and our total liability for any claim will not exceed the amount you paid us in the 12 months before the claim arose.

10. Governing law

[TBD] — the governing law and dispute-resolution jurisdiction for these Terms depend on the legal entity and merchant-of-record structure that has not yet been finalized (see TODO.md"Confirm Stripe VN merchant-of-record eligibility").

11. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will provide notice before they take effect.
